These Terms and Conditions ("Terms") govern access to and use of TracFlock, a church management platform owned and operated by EQUIMAX LLC ("TracFlock," "we," "us"). By creating an account or using TracFlock, you agree to these Terms on behalf of yourself and the organization you represent ("Organization," "you").
1. The Service
TracFlock provides software for churches and ministries to track visitors, leads, and members, manage groups and events, and communicate with contacts by email and text message. Plans and the free trial are described at tracflock.com/#pricing.
2. Accounts & Your Responsibilities
- You're responsible for the accuracy of information entered into TracFlock, including contact records for your visitors, leads, and members.
- You're responsible for having a lawful basis and any consent required, under applicable law, to store and communicate with the contacts you enter — including sending them email or text messages through TracFlock.
- You're responsible for keeping your account credentials secure and for activity that happens under your account.
3. Acceptable Use
You agree not to use TracFlock to:
- Send unsolicited messages to anyone who hasn't consented to receive them, or continue messaging anyone after they've opted out.
- Send spam, phishing attempts, or content that's unlawful, harassing, or fraudulent.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to TracFlock's systems.
4. SMS/Text Messaging Program Terms
When you use TracFlock's texting feature to message your own contacts, the following terms apply to that program:
- Message frequency varies depending on how often you choose to send messages to your contacts.
- Msg & data rates may apply, depending on the recipient's mobile carrier and plan.
- Recipients can reply STOP at any time to opt out of further text messages — this is honored immediately and automatically.
- Recipients can reply HELP to a text message for assistance, or contact the Organization that sent it directly.
- Support contact: for questions about TracFlock's texting feature, email support@tracflock.com.
- Carriers are not liable for delayed or undelivered messages.
Full details on how phone numbers and message content are handled are in our Privacy Policy, including that no mobile opt-in data is shared with third parties for marketing purposes.
5. Fees & Billing
Paid plans are billed in advance on a recurring basis through Stripe, as described at checkout. You can cancel or change plans at any time from your account's billing page; changes take effect at the start of the next billing period unless otherwise stated.
6. Intellectual Property
TracFlock and its software remain our property. You retain ownership of the contact and organizational data you enter into TracFlock ("Your Data"). You grant us a limited license to host, process, and transmit Your Data solely to provide the service to you.
7. Disclaimers
TracFlock is provided "as is." We don't guarantee the service will be uninterrupted or error-free, and we aren't responsible for the content of messages you choose to send through it.
8. Limitation of Liability
To the extent permitted by law, TracFlock isn't liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
9. Termination
You may stop using TracFlock and cancel your account at any time. We may suspend or terminate accounts that violate these Terms, including the Acceptable Use section above.
